These Terms and Conditions govern your use of AIFortess products and services. By using our services, you agree to these terms. Please read them carefully.

1. Definitions

• "AIFortess," "we," "us," or "our" refers to AIFortess Infosec FZCO, a company registered in Dubai, United Arab Emirates.
• "Products" refers to AIFortess software products, including AIFortess Assessor.
• "Services" refers to all products, tools, and related services we provide.
• "You" or "your" refers to the individual or entity using our Services.

2. What We Provide

2.1 AIFortess Assessor

AIFortess Assessor is a readiness tool for ISO 42001 and AI governance. It helps users define AI systems, assess risks and controls, identify gaps, and export readiness insights.

2.2 What We Do Not Provide

• Certification or audit services
• Legal advice or compliance guarantees
• Assurance that using our products will result in certification
• Replacement for professional judgment or qualified advisors

3. Account Terms

3.1 Account Creation

• You must provide accurate information when creating an account
• You must be at least 18 years old
• Business accounts must be created by authorized representatives

3.2 Account Security

• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized access
• You are responsible for all activity under your account

4. Early Access Program

AIFortess Assessor is currently available through an early access program. This means:

• Access is by invitation or request
• The product may change based on user feedback
• Features may be added, modified, or removed
• You work directly with the founder during onboarding
• Your feedback helps shape the product

5. Pricing and Payment

Pricing for AIFortess products is determined on a case-by-case basis during early access. When you request access, we will discuss pricing that fits your use case. All pricing is communicated clearly before you commit to any payment.

5.1 Payment Terms

• Payment terms are agreed upon before service begins
• Invoices are due within the agreed payment period
• We accept standard payment methods

6. Intellectual Property

6.1 Our Property

• All software, documentation, and content are our property
• You receive a limited license to use our products during your subscription
• You may not copy, modify, reverse engineer, or redistribute our products

6.2 Your Data

• You retain all rights to data you enter into our products
• You grant us a license to use your data solely to provide the Services
• We will not share your data with third parties except as described in our Privacy Policy

7. Acceptable Use

You agree not to:

• Use our Services for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our Services
• Upload malware or harmful code
• Resell or transfer your access without permission
• Use automated systems to access our Services without authorization

8. Privacy and Data

Your privacy matters to us. Our data practices are described in our Privacy Policy. Key points:

• We collect only the data necessary to provide our Services
• We do not sell your personal information
• We implement reasonable security measures to protect your data
• You can request deletion of your data

9. Service Availability

We work to keep our Services available, but we cannot guarantee uninterrupted access. We may:

10. Termination

10.1 By You

• You may cancel your account at any time
• Cancellation terms are described in our Refund Policy
• You can export your data before cancellation

10.2 By Us

We may suspend or terminate your access if you:

• Fail to pay fees when due
• Engage in activity that harms our Services or other users

10.3 After Termination

• Your access to the Services will end
• You may export your data within 30 days
• Outstanding fees remain due

11. Disclaimers

11.1 No Guarantees

Our Services are provided "as is" without warranties of any kind. We do not guarantee that:

• The Services will meet your specific requirements
• The Services will be error-free or uninterrupted
• Results from using the Services will be accurate or reliable
• Using our products will result in certification or compliance

11.2 Compliance Disclaimer

AIFortess products provide tools and frameworks for governance work. They do not provide certification, legal advice, or compliance guarantees. You are responsible for your own compliance decisions and should consult qualified professionals as needed.

12. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability is limited to the amount you paid us in the 12 months preceding any claim
• We are not liable for indirect, incidental, or consequential damages
• We are not liable for loss of profits, data, or business opportunities

13. Indemnification

You agree to indemnify AIFortess from claims arising from:

• Your use of our Services
• Your violation of these Terms
• Your violation of third-party rights
• Data you submit to our Services

14. Dispute Resolution

14.1 Informal Resolution

Before formal proceedings, we agree to attempt to resolve disputes through good faith discussion for at least 30 days.

14.2 Governing Law

These Terms are governed by the laws of the United Arab Emirates. Disputes will be resolved in the courts of Dubai, UAE.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and AIFortess.

15.2 Changes to Terms

We may update these Terms. Material changes will be communicated via email. Continued use after changes constitutes acceptance.

15.3 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

15.4 No Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

15.5 Assignment

You may not assign these Terms without our consent. We may assign our rights without restriction.
